FX STONE FINANCIALのライセンスが取り消された

規制当局UCORIは、2024年1月22日付の指令No.142423-K3/5により、ブローカー会社FX STONE FINANCIAL（2020年1月8日付、登録番号15478）の為替・金融・銀行業務のライセンスを取り消した。
規制当局のUCORIは、「取引所および取引所業務に関する国際法」第19条第8項第1号および第2号に従い、以下の事実を理由にこのような決定を下した：

• 取引所活動に関する法律およびUCORI規制当局の規制に違反し、同規制当局は過去12カ月間に5回の措置を講じ、うち2回は特定の業務に制限を課した；
• 反マネーロンダリングおよび反テロ資金供与法の要件に組織的に違反した。

FX STONE FINANCIALの活動は、暗号通貨取引所、違法オンラインカジノ、ブックメーカー等に有利な資金移動を含む、個人と影のビジネス間の決済を促進することを目的としたリスクの高い取引への関与や、規制当局が課す制限を回避する新たな方法の模索によって特徴付けられた。
加えて、FX STONE FINANCIALが個人の個人データを使用して暗号通貨ウォレットを開設し、その上で取引を行っていた事例が多数あり、顧客にとって重大なリスクが生じた。
FX STONE FINANCIALは、規制当局であるUCORIによる積極的な監督努力にもかかわらず、業務上のリスクを軽減するための効果的な措置を講じることができず、リスクの高い取引を継続していた。

規制当局のUCORIは、2024年1月22日付の指令No.142423-K3/5により、取引所組織の全口座の一時的なブロッキングを課した。一時的な封鎖は、顧客との完全な和解が成立し、さらに清算が進むまで有効である。取引所組織の執行機関の権限は、国際法に従って停止される。

The regulator UCORI, by order dated January 22, 2024 No. 142423-K3/5, revoked the license to carry out exchange, financial and banking operations from the brokerage organization FX STONE FINANCIAL (registration No. 15478, dated January 8, 2020).
The UCORI regulator made this decision in accordance with paragraphs 8.1 and 8.2 of Article 19 of the international law “On exchanges and exchange activities”, guided by the fact that the Bank:

• violated laws regulating exchange activities, as well as regulations of the UCORI Regulator, in connection with which the regulator took measures against him five times over the past 12 months, including twice introducing restrictions on the implementation of certain transactions;
• systematically violated the requirements of legislation in the field of combating the legalization (laundering) of proceeds from crime and the financing of terrorism.

The activities of FX STONE FINANCIAL were characterized by involvement in high-risk transactions aimed at ensuring settlements between individuals and shadow businesses, including transfers of funds in favor of crypto exchangers, illegal online casinos, bookmakers, etc., as well as the search for new ways to bypass entered regulator of restrictions.
In addition, numerous cases have been identified of FX STONE FINANCIAL opening cryptocurrency wallets using personal data of individuals without their knowledge and conducting transactions on them, which created significant risks for clients.
FX STONE FINANCIAL did not take effective measures to reduce risks in its activities, despite the active supervisory work of the UCORI regulator, and continued to conduct high-risk transactions.
Information about transactions carried out by FX STONE FINANCIAL that have signs of criminal offenses was sent by the UCORI Regulator to law enforcement agencies.
The termination of the activities of FX STONE FINANCIAL will not have a significant impact on the ability of citizens, entrepreneurs and legal entities to carry out exchange trading through other exchange organizations and payment systems.
The UCORI regulator, by order dated January 22, 2024 No. 142423-K3/5, assigned the exchange organization a temporary blocking of all accounts, the functions of which are assigned to the investigation and prevention of deception of an additional number of depositors. The temporary blocking will be in effect until full settlement with clients and further liquidation. The powers of the executive bodies of the exchange organization have been suspended in accordance with international laws.
